On March 8, 2019, the Newport County Grand Jury returned an indictment charging Cary Pacheco with one count of delivering a controlled substance (fentanyl), death resulting; one count of delivering a controlled substance (heroin); one count of delivering a controlled substance (fentanyl); one count of delivering a controlled substance (tramadol); and one count of conspiracy.

The alleged acts occurred in the city of Newport sometime between September 10, 2018 and November 29, 2018. The Newport Police Department conducted the investigation.

The defendant is currently being held without bail at the Adult Correctional Institute and is scheduled to be arraigned on March 14, 2019 in Newport County Superior Court.
